What Probate and Trust Administration Mean

When someone passes away, their property has to be handled and passed on. In California, this usually happens in one of two ways.

Probate

Probate is a court-supervised process. The court confirms who is in charge of the estate, usually called the executor, and makes sure debts are paid and the property goes to the right people. Probate can take time, and the home often can’t be sold until the court allows it.

Trust

Trust administration happens when the person put their property into a trust before they passed. The person in charge, called the trustee, manages and passes on the property following the trust’s instructions. This is usually done without going to court.

Probate

Probate is a court-supervised process. The court oversees the estate, and the executor is in charge. It often takes longer, and court records are generally public. Selling the contents may need to follow court rules, and selling the house may need the court’s approval, depending on the case.

Trust

A trust is a private arrangement. The trustee manages the property and passes it on following the trust’s terms, usually without going to court. It often moves faster and is generally more private. The trustee decides how the contents are sold, and can usually sell the house if the trust allows it.

What it means for the sale

The path affects the timing and who needs to approve each step. Your attorney can tell you which rules apply, and we plan the estate sale, the cleanout and the home preparation around them.

How does probate and trust affect the sale?

The two paths work differently, and the difference can affect how and when the contents and the home are sold.

How We Help With Probate and Trust Properties

We take care of the home and its contents, so you can focus on the legal and family side of things.

Itemized inventory

We make a detailed list of what’s in the home. It gives the executor or trustee a clear record, and it can help when the attorney needs to see what the estate holds.

Working with your attorney

We coordinate with your attorney, so the work follows their guidance and the timing fits the legal process.

Clearing and preparing the property

Items with value are sold through an estate sale, and you receive a clear report of what sold.

Empty home

We clear what’s left and prepare the home, whether it’s being sold, handed over or closed out.

Who Does What

Several people are usually involved in a probate or trust property. Here is how the roles fit together.

Executor or trustee

The person in charge of the estate or trust. They make the decisions, sign the paperwork and make sure the property is handled according to the will or the trust.

Attorney

Gives legal advice and guides the executor or trustee through the process, including what the court requires.

Family

Shares what matters to them, chooses what to keep, and stays in the loop. Family members may also be beneficiaries, who receive part of the estate.

Our team

Takes care of the home and its contents: the inventory, the estate sale, the cleanout and preparing the property. We follow the direction of the executor or trustee and coordinate with the attorney.

Transparent Accounting

Transparent Accounting From Start to Finish

Every item in your home goes into our inventory system. Valuable pieces get their own photo and price. Smaller items are grouped and logged, so nothing goes missing from the record.

When the sale starts, each purchase is tracked at checkout. You get a sales update every day, and a professional report at the end that shows what sold and what you earned.
